29 Oct 09 Pending Shoulder Pain Pump Lawsuit is One of Many

Since June 2009, Laura Ashworth and her ex-husband Jeffery Ashworth have been seeking compensation for the injuries and losses they claim to have experienced as a result of using the I-Flow Corporation's On-Q Painbuster pain pump.

According to official court documents, Laura Ashworth had two shoulder surgeries in 2006. It was during the second surgery that physicians implanted an I-Flow Pain Pump into her shoulder joint. Over time, the pump administered harmful medications to Ashworth and, as a result, caused her to sustain a painful, incurable condition known as postarthroscopic glenohumeral chondrolysis (PAGCL).

In addition to pain, PAGCL results in permanent loss of range of arm motion and significant weakness of the shoulder joint. The extent of the injuries required Ashworth to undergo a costly, invasive shoulder replacement surgery.

Plaintiff Seeks Compensation for Injuries

So far the Ashford's have filed three claims against the I-Flow Corporation, seeking compensation in excess of $75,000. The three claims are based on:

  • The company's failure to warn healthcare providers of the product's defects
  • Negligence, the pain pump wasn't FDA approved
  • Pain and suffering caused by the damage incurred

Ashworth is not the only plaintiff seeking compensation for her losses. In fact, shoulder pain pump lawsuits continue to spring up across the country as patients seek compensation for damages they incurred after being implanted with a faulty pain pump.

Injured plaintiffs will likely recover compensation for losses such as:

  • Costly medical and surgery fees
  • Physical pain and disfigurement
  • Loss of strength and range of motion in the shoulder
  • Severe pain in cases where PAGCL developed
  • Emotional suffering
Those injured after using the Stryker pain pump, the Donjoy shoulder pain pump or another other brand name shoulder pain pump should consult with an experienced shoulder pain pump lawyer to find out if they have a case. For more information about your own circumstances, contact us.
